Terms of Service

1. Acceptance of These Terms

By installing, accessing, or using THE EDGE ("the App"), you ("you") agree to these Terms of Service ("Terms"). These Terms form a binding contract between you and BEYOND EXPERIMENTAL ("we", "us"). If you do not agree, do not install or use the App.

2. Description of Service

THE EDGE provides:

• AI-driven probabilistic predictions for ATP and WTA tennis matches.
• A gamified per-account bankroll denominated in simulated in-app coins.
• A coin-based wager mechanic that settles when the underlying real-world match concludes.
• An optional "Pro" subscription that unlocks deeper analytics, live announcer audio, and additional features described in-app at the time of purchase.

3. Predictions Are Estimates, Not Guarantees

All predictions, edge ratings, confidence percentages, and recommendation outputs are model-driven probabilistic estimates produced by automated systems. They are not financial advice, sports-betting tips, investment recommendations, or guarantees of any outcome. Past model accuracy is not a guarantee of future accuracy. You are solely responsible for any decisions you make based on App content, including any external real-money decisions outside the App. To the fullest extent allowed by law, we are not liable for losses or damages resulting from reliance on App content.

4. Eligibility & Accounts

• You must be at least 17 years old (App Store age rating).
• You must be legally permitted to use the App in your jurisdiction.
• One account per person. You may not create accounts on behalf of others or impersonate other people.
• You are responsible for the security of your sign-in credentials, including your handle and PIN.
• You agree to provide accurate sign-up information; if you choose a handle, the handle must not be misleading, infringing, or offensive.

5. In-App Purchases & Pro Subscription

5.1 Billing

If you subscribe to THE EDGE Pro, the purchase is processed exclusively by Apple via the App Store using your Apple ID. We never receive your payment credentials. The advertised price is shown at the point of purchase and may vary by region. Apple's standard App Store Terms apply.

5.2 Auto-Renewal

Subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. The renewal charge is billed to your Apple ID account.

5.3 Manage / Cancel

Manage or cancel any time from iOS Settings → tap your name at the top → Subscriptions → THE EDGE. Cancellation takes effect at the end of the current period; you keep Pro features until then.

5.4 Free Trials & Introductory Offers

If we offer a free trial or introductory price, you accept that the subscription will convert to the standard recurring price at the end of the trial unless you cancel before the trial expires. Apple may not allow a second trial on the same Apple ID.

5.5 Refunds

All refund requests are handled by Apple per their standard policy at reportaproblem.apple.com. We do not issue refunds directly because we do not process the payment.

5.6 What Pro Unlocks

The exact Pro feature set is shown at purchase time and may evolve. As of this writing it includes the full prediction analysis (deep edge breakdown, market intelligence, confidence percentage, exact win probabilities), full daily picks, advanced track-record analytics, the premium live announcer voice, premium share styles, additional cosmetics, removal of all interstitial advertisements, and a higher daily bankroll reload (2,500 simulated coins per 24h vs 500 on free tier). We may add, remove, or change Pro features. Material reductions in feature set will be announced via in-app notice; if you object, your sole remedy is to cancel.

5.7 Virtual Currency

The in-app coin balance has no cash value. We may grant, revoke, or adjust coin balances at our discretion (for example, to roll back exploits or fix bugs). Coins do not roll over to a new account if you delete and re-register.

6. Account Deletion

You can delete your account at any time from in-app Settings → Delete Account. Deletion is permanent and immediate: your handle is freed for re-registration, your bankroll history, prediction history, settings, achievements, and inventory are all dropped from our database. We cannot restore a deleted account. If you have an active Pro subscription, the subscription is NOT cancelled by account deletion — you must separately cancel it from iOS Settings (we have no way to cancel an Apple-billed subscription on your behalf).

7. Acceptable Use

You agree NOT to:

• Reverse-engineer, decompile, or attempt to extract the model.
• Scrape predictions, edge ratings, or live data programmatically beyond ordinary in-app use.
• Attempt to circumvent rate limits, authentication, paywall gates, or abuse-prevention systems.
• Use bots, scripts, or other automated means to interact with the App.
• Resell, sublicense, or distribute access to the App or any subset of its data.
• Use the App in connection with unauthorized real-money sportsbooks or any sports-betting service that does not comply with applicable law in your jurisdiction.
• Attempt to access another user's account, profile, or personal data.
• Submit content (handles, names) that is unlawful, infringing, hateful, harassing, or sexually explicit.

We may suspend, restrict, or terminate accounts that violate this section, with or without notice, at our reasonable discretion.

8. Intellectual Property

THE EDGE, including its visual design, prediction model, analyzer audio, brand, and code, is owned by BEYOND EXPERIMENTAL and protected by copyright, trademark, and other laws. We grant you a personal, non-transferable, non-exclusive, revocable license to use the App for your own personal, non-commercial use. All player names, photographs, and tournament metadata remain the property of their respective owners and are used under fair-use, factual-data, or licensed-source provisions.

9. Privacy

Our handling of personal data is governed by the Privacy Policy, which is incorporated by reference into these Terms.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEYOND EXPERIMENTAL DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT PREDICTIONS WILL BE ACCURATE, THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEYOND EXPERIMENTAL'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (US$100), WHICHEVER IS GREATER. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS; IN THOSE JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

12. Indemnity

You agree to indemnify and hold BEYOND EXPERIMENTAL harmless from any claim, demand, loss, or damages, including reasonable attorneys' fees, arising from (a) your use of the App, (b) your violation of these Terms, (c) your violation of any third-party right, or (d) any content you submit to the App.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be resolved exclusively in the state or federal courts located in Delaware, and you and we consent to personal jurisdiction there. Where applicable, the United Nations Convention on Contracts for the International Sale of Goods does not apply.

If you are an EU/UK consumer, this section does not deprive you of mandatory consumer-protection rights in your home country.

14. Force Majeure

We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, network outages, cloud-provider failures, denial-of-service attacks, fire, flood, accidents, strikes, or shortages of materials, transport, or labor.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via in-app notice or by posting the updated Terms with a new "Last updated" date. Continued use after changes take effect constitutes acceptance. If you do not accept the updated Terms, your sole remedy is to delete your account.

16. Termination

You may terminate at any time by deleting your account. We may terminate or suspend your access at any time, with or without notice, for violation of these Terms, abuse, security risk, fraud, illegality, or extended inactivity. Upon termination, sections 8–13, 15, and 17 of these Terms survive.

17. Miscellaneous

• Severability: If any provision is unenforceable, the remaining provisions remain in full effect.
• No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
• Entire agreement: These Terms plus the Privacy Policy form the entire agreement between you and us regarding the App.
• Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
• No third-party beneficiaries except that Apple is a third-party beneficiary of any provision of these Terms required by App Store Review Guidelines.
